Call Me In 5 — Terms of Service

1. Introduction
These Terms of Service ("Terms") govern your access to and use of Call Me In 5 (the "Service").
By creating an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and the accompanying Privacy Policy.
If you do not agree with these Terms, you must not use the Service.
2. Description of the Service
Call Me In 5 lets you schedule an automated phone call to your own verified phone number. At the scheduled time, you receive a call featuring an AI-generated voice presenting a fictional, time-sensitive scenario, intended to give you a reason to excuse yourself from a situation.
The Service is provided for personal entertainment and convenience.
3. Eligibility and Accounts
You must create an account and verify a phone number to use the Service. You agree to:
- provide accurate information
- verify a phone number that you personally own and control
- maintain the confidentiality of your account credentials
- notify us of any unauthorized access to your account.
You remain responsible for all activity conducted through your account.
4. Verified Number Only
The Service places calls only to a phone number you have verified you own. There is no feature that allows you to direct a call to any other person's number.
You agree that you will not attempt to use the Service to place calls to any number that is not your own verified number.
5. Acceptable Use
The Service is designed for harmless personal use. You agree not to:
- use the Service to harass, deceive, defraud, or harm any other person
- attempt to place calls to numbers you do not own
- use the Service for any unlawful purpose
- circumvent or attempt to circumvent usage limits or verification requirements
- reverse engineer, disrupt, or interfere with the operation of the Service
- use the Service in violation of any applicable telecommunications, anti-spam, or telemarketing laws.
The Service is not an autodialer, telemarketing tool, or mass-calling system, and must not be used as one.
6. Usage Limits
To keep the Service functioning as intended and to prevent abuse, the following limits apply:
- calls are placed only to your verified number
- one scheduled call at a time
- a maximum of five (5) calls per day.
These limits are enforced by the Service and may be adjusted at our discretion.
7. AI-Generated Content
Calls use an automated, synthesized voice and present fictional scenarios. The content of a call is generated by an automated system, may be imperfect, and is intended solely as a harmless pretext. It does not represent real events, real people, or any genuine emergency.
8. Service Availability
The Service is provided "as is" and "as available."
We do not guarantee that the Service will be uninterrupted, error-free, or that a scheduled call will always be placed successfully or on time. Call delivery depends on third-party telecommunications providers and other factors outside our control.
9. Third-Party Providers
The Service relies on third-party providers, including Twilio (telephony) and Vapi (AI voice). Your use of the Service is also subject to the availability and terms of these providers. We are not responsible for failures or interruptions caused by third-party providers.
10. Intellectual Property
All content and software making up the Service is the property of the operator. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended personal purpose.
11. Termination
We may suspend or terminate your access to the Service at any time, including for any violation of these Terms or any misuse of the calling functionality.
You may delete your account at any time. Upon deletion, your account data, including your phone number, is deleted as described in the Privacy Policy.
12. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, consequential, or special damages, or for any loss arising from:
- use of or inability to use the Service
- failed, delayed, or misdelivered calls
- any consequence of you acting on or playing along with a call
- third-party service disruptions.
The Service is a novelty tool. You are solely responsible for how you use it and for any real-world decisions you make in connection with it.
13. Indemnification
You agree to hold harmless the operator from any claims, damages, or costs arising from your use of the Service or your violation of these Terms.
14. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after an update constitutes acceptance of the revised Terms.
15. Governing Law
These Terms are governed by the laws of the Province of Québec and the federal laws of Canada applicable therein.
